Terms of service
These Terms of Use (hereinafter referred to as the "Terms") stipulate the terms and conditions of the online shop service (hereinafter referred to as the "Service") provided by Yamama Seitojo (hereinafter referred to as the "Company") on this website. Users (hereinafter referred to as "Users") are requested to use the Service in accordance with these Terms.
Article1 (Application)
- These Terms shall apply to all relationships related to the use of the Service between Users and the Company.
- The Company may establish rules and various provisions (hereinafter referred to as "Individual Provisions") in addition to these Terms regarding the use of the Service. Regardless of their names, these Individual Provisions shall constitute a part of these Terms.
- In the event of a conflict between the provisions of these Terms and the Individual Provisions in the preceding paragraph, unless otherwise specified in the Individual Provisions, the provisions of the Individual Provisions shall take precedence.
Article2 (User Registration)
- In the Service, a person who wishes to register shall apply for user registration by agreeing to these Terms and following the method specified by the Company. User registration is completed when the Company notifies the applicant of the approval of the registration.
- The Company may not approve a user registration application if it determines that the applicant falls under any of the following reasons, and shall not be obligated to disclose the reasons:
- If false information is provided during the application for user registration
- If the applicant has violated these Terms
- If the Company deems the user registration inappropriate for any other reason
Article3 (Management of User ID and Password)
- Users shall be responsible for managing their user ID and password for the Service.
- Under no circumstances should users transfer, lend, or share their user ID and password with a third party. If a user ID and password combination matches the registration information and is logged in, it will be deemed as the user's own usage.
- The Company shall not be liable for any damages caused by the use of a user ID and password by a third party, except in cases where the Company has intentional or gross negligence.
Article4 (Sales Contract)
- In the Service, a sales contract is deemed to be concluded when a user applies to the Company for a purchase and the Company notifies the user of the acceptance of the application. Ownership of the product shall transfer to the user when the Company delivers the product to the delivery agent.
- The Company may cancel the sales contract without prior notice to the user if the user falls under any of the following reasons:
- If the user violates these Terms
- If the delivery of the product is not completed due to an unknown recipient or prolonged absence
- If the trust relationship between the Company and the user is deemed to be damaged for any other reason
- Payment methods, delivery methods, cancellation methods for purchase applications, and return methods related to the Service shall be determined separately by the Company.
Article5 (Intellectual Property Rights)
The copyright and other intellectual property rights of the content provided by the Service, such as product photos and other content (hereinafter referred to as "Content"), belong to legitimate rights holders such as the Company and content providers. Users are not allowed to reproduce, reprint, modify, or otherwise reuse them without permission.
Article6 (Prohibited Acts)
Users are prohibited from engaging in the following acts when using the Service.
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that infringe on copyrights, trademarks, or other intellectual property rights included in the Service
- Acts that disrupt or interfere with the function of the Company's servers or networks
- Commercial use of information obtained through the Service
- Acts that may interfere with the operation of the Company's services
- Unauthorized access or attempted unauthorized access
- Collecting or storing personal information of other users
- Impersonating other users
- Directly or indirectly providing benefits to antisocial forces related to the Company's services
- Any other acts deemed inappropriate by the Company
Article7 (Suspension of Service Provision, etc.)
- The Company may suspend or interrupt all or part of the provision of the Service without prior notice to the user if it determines that any of the following reasons exist:
- When maintenance, inspection, or updating of the computer system for the Service is necessary
- When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
- When the computer or communication line is stopped due to an accident
- When the Company deems the provision of the Service to be difficult for any other reason
- The Company shall not be liable for any disadvantages or damages incurred by the user or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.
Article8 (Restriction of Use and Deletion of Registration)
- The Company may restrict the use of all or part of the Service or delete the registration of a user without prior notice if the user falls under any of the following:
- Violation of any provision of these Terms
- Discovery of false facts in the registered information
- The user's credit card provided as a payment method has been suspended
- Failure to fulfill payment obligations such as fees
- No response to Company's contact for a certain period
- No use of the Service for a certain period after the last use
- When the Company deems the user's use of the Service to be inappropriate for any other reason
- The Company shall not be liable for any damages caused to the user by the actions taken by the Company based on this article.
Article9 (Withdrawal)
Users may withdraw from the Service through the prescribed withdrawal procedure.
Article10 (Disclaimer and Limitation of Liability)
- The Company does not guarantee that the Service is free from defects in fact or law (including defects related to safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security, errors, bugs, infringement of rights, etc.).
- The Company shall not be liable for any damages incurred by the user through the Service. However, if the contract between the Company and the user regarding the Service (including these Terms) falls under the Consumer Contract Act, this disclaimer provision shall not apply. Even in this case, the Company shall not be liable for damages caused to the user due to non-performance of obligations due to gross negligence or tort by the Company, except for damages arising from special circumstances (including cases where the Company or the user could foresee or could have foreseen the occurrence of damages).
- The Company shall not be liable for any transactions, contacts, disputes, etc., between users and other users or third parties regarding the Service.
Article11 (Changes to Service Content, etc.)
The Company may change the content of the Service or suspend the provision of the Service without notifying the user, and shall not be liable for any damages caused to the user as a result.
Article12 (Amendment of Terms of Use)
The Company may amend these Terms at any time without notifying the user if deemed necessary. After the amendment of these Terms, if the user starts using the Service, the user shall be deemed to have agreed to the amended terms.
Article13 (Handling of Personal Information)
The Company shall handle personal information obtained through the use of the Service appropriately in accordance with the Company's "Privacy Policy."
Article14 (Notice or Communication)
Notifications or communications between the user and the Company shall be conducted through the method specified by the Company. Unless the user submits a change notification in accordance with the method separately specified by the Company, the currently registered contact information shall be deemed valid, and notifications or communications sent to that contact information shall be deemed to have reached the user at the time of dispatch.
Article15 (Prohibition of Assignment of Rights and Obligations)
Users may not assign or pledge their position under the service contract or rights or obligations based on these Terms to a third party without the Company's prior written consent.
Article16 (Governing Law and Jurisdiction)
- The interpretation of these Terms shall be governed by Japanese law. However, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded regarding the Service.
